If you feel that there might be a possibility that you could come to some agreement with your partner over some of the issues which you need to resolve between you, then mediation might be appropriate for you both. Mediation involves you both meeting together with an experienced solicitor mediator for a number of Mediation sessions. Your solicitor mediator’s role is to explain all the options available to you both and to help you both build settlement terms acceptable to you both.
This option is non adversarial and is favoured by many couples who have children and who want to work out together with the solicitor mediators help, what is best for everyone. You have complete control over the outcome, unlike an outcome handed down by a Judge in Court and you also have complete control of the costs, unlike the Court process. For people who believe that for the sake of their children they must continue to be good parents, despite no longer being partners, mediation is a popular choice. Those people appreciate that it is sometimes difficult for ex-partners to have a good on-going parenting relationship after they have both been through a Court process.
This process is a type of mediation but instead of there being one neutral solicitor mediator helping you both, you each have your own collaborative lawyer present with you during the meetings, helping you to build your settlement terms.
This process can be lengthier than the mediation process and is usually much more costly, because you have two collaborative lawyers assisting you instead of one neutral solicitor mediator. Many people simply cannot afford two solicitors at each meeting.
Purely for reasons of cost, collaborative law has not proved to be as popular as mediation with the majority of client.
The Court Process
For some people it is impossible, for a variety of reasons, to ever sit in the same room as their partner or ex- partner in order to work out settlement terms with a third party. They may have been threatened or intimidated by their partner or ex-partner, or there may be some other perfectly good reasons why a mediated settlement or a collaborative settlement is impossible.
